Welcome to Artsie! These Terms of Service ("Terms") govern your use of our website, services, and platform (collectively, the "Services"). By accessing or using Artsie, you agree to these Terms. If you do not agree, please do not use our Services.

Acceptance of Terms By creating an account, browsing, or making a purchase on Artsie, you confirm that you are at least 16 years old (or the age of majority in your jurisdiction) and agree to these Terms. If you are using Artsie on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Description of Services Artsie is an online marketplace that connects Canadian artists ("Creators") with collectors and art enthusiasts ("Collectors") to buy and sell original artwork. Our Services include: Hosting artist profiles and artwork listings. Facilitating transactions between Creators and Collectors. Providing tools for communication, marketing, and payment processing.

User Accounts Account Creation: To use certain features, you must create an account and provide accurate information.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Termination: Artsie reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or harmful behaviour.
- Buying and Selling on Artsie For Collectors: You may purchase artwork listed on Artsie. All sales are final unless otherwise stated by the Creator. Returns, Credits and/or Exchanges are facilitated through the Creator directly. Concerns are addressed and handled by the Creator directly.
Payment processing is handled through secure third-party providers.
For Creators: You may list ORIGINAL artwork for sale, provided it complies with our guidelines and does not infringe on third-party rights. Exceptions include prints and professional reproductions which were created by you. Items featured under your account are to be created solely by the approved Artist.
Artsie charges a commission on each sale, as outlined in your account settings.
- Intellectual Property Creators: You retain ownership of your artwork but grant Artsie a non-exclusive, royalty-free license to display, promote, and distribute your work on the platform, and other Artsie promotional material and socials.
By signing up as a Creator on Artsie, you grant Artsie a non-exclusive, royalty-free license to use photographs of your artwork for promotional purposes, including but not limited to social media, marketing materials, and website content. You acknowledge that this use may extend beyond the time you are actively using the platform, and you will not be compensated for such use. This license allows Artsie to promote your work and the platform as a whole, helping to grow your audience and connect you with collectors.
Collectors: Purchasing artwork grants you ownership of the physical piece but does not transfer copyright or reproduction rights unless explicitly agreed upon with the Creator.
- Prohibited Activities You agree not to:
Post false, misleading, or harmful content.
Infringe on intellectual property rights.
Engage in fraudulent or illegal activities.
Use automated tools to scrape or interfere with the platform.
- Fees and Payments Commissions: Artsie charges a commission on each sale, which is deducted from the total payment.
Taxes: You are responsible for any applicable taxes related to your transactions.
Shipping: Collectors are responsible for charges associated with shipping fees as determined by the Creator.
Refunds: Refunds are handled on a case-by-case basis and must be negotiated directly between Creators and Collectors.
- Disclaimers and Limitations of Liability As-Is Basis: Artsie provides the Services "as is" and makes no warranties regarding their accuracy, reliability, or availability.
Limitation of Liability: Artsie is not liable for any indirect, incidental, or consequential damages arising from your use of the Services.

Indemnification You agree to indemnify and hold Artsie harmless from any claims, damages, or losses arising from your use of the Services or violation of these Terms.

Governing Law These Terms are governed by the laws of Ontario, Canada. Any disputes will be resolved in the courts of Ontario, Canada.

Changes to These Terms We may update these Terms from time to time. If we make significant changes, we will notify you by email or through a notice on our website. Your continued use of Artsie after such changes constitutes your acceptance of the updated Terms.

Sellers are responsible for including all applicable taxes (e.g., sales tax, GST/HST) in the listed price of their artwork. Sellers must also ensure compliance with tax laws and remit any required taxes to the appropriate authorities. Artsie acts solely as a platform to facilitate transactions and does not assume responsibility for tax collection or remittance.

User Conduct- Responsibilities and Prohibited Actions
Creators are expressly prohibited from using Artsie to promote their personal or business websites, social media accounts, or any external platforms. All transactions, communications, and interactions between creators and collectors must be conducted exclusively through the Artsie platform. Any attempt to bypass Artsie for sales or promotions is a violation of this policy. Artists found in breach of these terms risk having their account suspended temporarily or indefinitely, at the sole discretion of Artsie. This policy ensures a fair and secure marketplace for all users and protects the integrity of the Artsie community.
Users of Artsie’s website are strictly prohibited from using, copying, reproducing, or distributing any images, artwork, or content found on the platform without the express written permission of the creator. Unauthorized use of these materials constitutes a violation of intellectual property rights and may result in legal action. By using Artsie, you agree to respect the creative works of our artists and adhere to these terms.
